New Build Available: A208

Hi all,
We've been off the air for a bit from a build perspective, but released a new one for you this morning. It includes updates in the following area:

- Swarmcast updates/bugfixes for better high quality streaming
- Addition of Swarmcast version for troubleshooting
- Video updates to mosaic client/install to detect incompatible hardware
- Mac stability/bugfixes
- CPU usage is now better on the Mac
- Additional on-demand playback updates

Again, we appreciate all of your feedback. The engineering team and I are continuing to work with you all via the threads here to provide support, and we're also in parallel now working on getting a support forum set up to consolidate what we all have learned and shared with you.

With the new 4:3 ratio, after exiting fullscreen mode, Mosaic doesn't properly resize itself.


Here is what I'm talking about with links to photographs:

When I open Mosaic it fills my screen:

Please fix this so the program resets itself when I exit fullscreen. Also, bring back true fullscreen so I can enjoy Mosaic again. Watching the games in boxes is not cool. It wasn't bad at all for stretching as far as I am concerned. A lot of others commented the same thing in the comments for under the 205 post.

Thanks, it's actually odd that the initial screen comes up stretched like it does. I'll have to test and figure out that case. The other views with the black bars are the app running in the correct aspect ratio.

The 4/6 box views looked really squished with the bars down the side. I just want it to return to the way it is when it opens. The larger the small boxes, the easier to view

With this new update, I'm actually getting the highest quality level. It is freezing a bit, but considering my video card is on the list of unsupported ones. It doing very well. Picture is great, in all areas..:)

For whatever reason, I am getting true fullscreen again :) Only problem is the blue windows bar won't disappear at the top.

I really don't see much distortion of anything funny going on in the picture on my end. That's why I would rather see the program give us a true fullscreen option.

Anyways, whatever is going on with Mosaic that it stays true fullscreen right now, I like it. I won't be closing the program for a long time.

The sound is garbage.

My computer has more than the minimum requirements with the latest drivers.

I get the message: Unable to connect. Try a different quality level. I have it set to its lowest. How low are you supposed to go? radio?

You guys have to admit this is buggy, unreliable and overpriced.

Do you give refunds?

With the new update, I am receiveing more buffering than ever and "Stream Error, Retrying" messages are constant. I guess it's back to the single-game mode.

Okay, here's a new one. The Sox-Blue Jay game says it's archived; however, all I get is the MLB.tv guy doing a looping preview. Any suggestions?

What system are you running? Those screenshots are impressive. I haven't been able to get anything close to that, and I am running the fastest Mac laptop possible.

The video quality of this new update is by far the best I have seen thus far this spring, which is great.


However, my one complaint is that I have to minimize mosaic in order to view any other windows. This wasn't the case with any of the other builds that have been released. Hopefully this can be fixed, otherwise everything is good!

I am running an AMD 3500, ATI Radeon X700 (256) and a gig of ram. It's not a super powerful computer but enough to do what I want as I don't game with it.

I have my computer connected to my Samsung 46-inch 1080p LCD via VGA port. Might see about getting an HDMI video hookup sometime soon.

As I've said from the get-go, I was very-pleased with the true fullscreen with my setup. My tv has a button to convert everything to 4:3 if I want but I prefer viewing widescreen for computer programs. TV programming is a different deal.

Everything seems to work fine, except every 10-30 seconds, all the video goes into slo-mo, then after a second, it goes into fast motion to catch up to where it was.


Any suggestions for how to fix this? I tried upping the task priority, but the act of doing that breaks the video playback completely.

This is on XP Pro BTW. 2ghz P4, 768 megs ram, GeForce 6600 GT.

Now, all archived games go into the Baseball Channel, but not the games.

Oh yeah, audio is about 2 seconds out on everything as well.

Thanks for the info. What speed connection do you have? I think that may be the key to it all. My system is two weeks old, so I know it's not the system.

Also, no bar at the top with the score in the ATL/Cubs game tonight.

I think it would be quite efficient to have a more inclusive FAQ than just labeling a section, "The MLB.TV Mosaic is acting strange..." There seems to be quite a few of us having issues that if we could read former complaints and remedies that others have proposed. Scrolling through 100+posts is not the most efficient method of problem solving.

I have a 10Mbps cable account. Doing the MLB speed test, I get a result of around 8,000kps.

After downloading the new build i have the same issue as hogan_disciple@hotmail.com from the first post did/does. i lost my fullscreen...i have a dark 2 inch border on the left and right side in all formats. i did not see a fix just a ...its all fixed now type deal. Any thoughts as to how i can my fullscreen back?

By eliminating the true full screen,what's the purpose of showing a game in widescreen? The picture has black borders on all sides, basically making it a smaller picture. Not an enjoyable viewing experience.

Okay, now it's just getting comical. I can access the archived games on my MacBook Pro, but when I try to access the archived games on my iMac that I use as TV, I keep getting the loop Baseball Channel Preview. Any thoughts?

Tried that. But it wasn't the Blue Jays pregrame, so there was anything I could FF to. It was the loop pregame that MLB.tv provides. However, I did a trash of Mosaic, reinstall, and now all is well. Still, I am envious of your picture. I may have to look into different levels of mbs from my Internet provider.

As I mentioned a few days ago, I had no problems with Mosaic once the initial problem was solved two weeks ago (audio drivers needed to be loaded).

I haven't been using my home computer much in last week or so, but I *still* have the newer problem of Mosaic stuck at "Connecting" that suddenly happened during one of the build updates, I believe.

I did have some connectivity troubles last week (bandwidth test was under 300 kbps!!!) so I didn't try for a few days.

(Related to that, I remember downloading Mosaic again that same night and the 15MB download took a good 2 minutes while I had downloaded a couple of minutes beforehand a HP printer driver file of 160MB that took only 4-5 minutes so it told me it was not really my side...)

Just recently, I tested bandwidth again and it is now 2418 kbps, which was/is typical. Just tried again, 2537 kbps.

Do you want me to do a tracert or something? Let me know.

Is there a launch day when I can sign on here, get a download, and have the product i pay for work, instead of steadily get worse?

Help, me out, When I Loaded my MLB Mosaic today it finally came up Minimized and when I attempt to Maximize it I just get a completely black screen. I closed it out and then tried to re-load it and nothing came up at all. Just said Launching Player, but nothing happens. anyone else with this problem?

Justin,my biggest problem is the 2 second audio delay with the video in all portals of the Mosaic Feature. This is really annoying. I have a DellXPS410 with Windows Vista Home Premium,Explorer 7,Media Player 11,and Microsoft.Net Framework 3.0. Are you addressing this problem? Can I do anything on my end? Please respond to this comment.

Can someone tell me why it is when I try and watch an archived game and jump to a certain inning, it just goes back to the start of the game? I'm using the Mac version. Is this a bug?

I also have the problem referenced by xeptowon. When my system was updated today, all I get is a small 2" screen showing the six games and if I click on it to change a game it opens up mlb.com. If I maximize it it just goes black.

Really no issues until this same thing happened last night. I checked this morning and the problem persists.

This latest build has given me lots of problems as well.
Black screen when maximized..more buffering..pausing then speeding up to catch up. It also seems to use up more CPU.

Nothing has changed with my system. Tried rebooting and reinstalling.

Is there anyway I can revert back to the previous release?

I cant get Mosaic to open any games. at the top it indicated connecting, but it never open the games...

What can I do?

Everything worked fine for me before the two latest updates. Now, I can't even watch anything (game highlights, archived games, top plays, etc.), there's only endless buffering.

I'm getting endless buffering on my Vista machine as well.

I noticed that, by accident, i was able to view one game in single view mode but with a small window showing another game in the top left hand corner. I do not know how I did it and cannot replicate it. Is this functionality now available. I did this after downloading Build A208

The problem is you are going from Maximized to full screen, and there is a bug in on that. To avoid the bug resize the window then go full screen. The Mosaic is not returning to its last state when that state is Maximized.

We fixed that in an update. You can click forward in the little bar under the video to advance past the 30min of into video.

That sounds like the Mosaic has been set to be always on top. Any applications that might be setting this for you? The mosaic by default does not do this, though many have requested it. Perhaps an application detects video playback and assumes you want it on top. Again not functionality built into the mosaic.

Do you have a router? That is where you need to enable UDP and UPnP. I have found windows firewall to not prevent the mosaic from running, unless blocked. Try connecting directly to the modem. Low stream does not use swarmcast so it is not a software issue if you cant connect on low.

With Mosaic running try the following

- Select Start

- Select Run

- Type in “CMD”

- At the DOS prompt type in “netstat –b”

It will display a list of programs running with the ports they are using.

See what ports MLB Mosiac and Swarmcast are using. Feel free to email me with a screen shot.

Can you please do the following?

- Click on [Start]

- Click on [Run]

- In the [Run] line type "DXDIAG" (no quotes).

- A DirectX dialog window will open.

- On that dialog will be a "Save all information as" button.

- Click that button and save the information as: “your_Name.TXT” to the Desktop

- Reply to this email and attach the file you just saved to the desktop. Once we get the file we will be able to see where the problem lies.

Not all games have this feature. However if the features is not available you should get a message box stating that. Please post the game you were watching and I can take a look. Or email me and I'll verify on my end.

Just reinstall the Mosaic. This is a rare issue with Vista, and a old version installed before the Vista fixes.

No way to roll back. From my records I see that you are using a video card that does not support DX9 so that will continue to be an issue as you use the Mosaic.

Do some speed tests, look over the tweaks. Lots of good information about how things work on the web.

Just saw the mosaic go "on top" and it wont go behind other windows. Also appears the line scores for archive games are at least an inning off. We'll get those things fixed up soon.

Trying to watch the StLouis Cubs game and it will only let me watch it in the 4/6 screen mode, not the single game mode

Well, the new update seemed to help me on the 4/6 viewer. Instead of rebuffering every 10 seconds it rebuffers every 40 seconds now. But, it holds for the 40 seconds in the medium video quality. The high quality level is unwatchable it still rebuffers every 10 seconds in the 4/6 viewing screen. It's an improvement but is still annoying when it rebuffers. Plus, the medium video quality is not that great. Are their still things being done to correct the rebuffering for the 4/6 viewing screen in medium and high quality video? I use a MAC version OSX 10.4.9 I have FLIP4MAC, Processor is 1.9 GHz Power PC G5, Memory is 512 MB.

I am using the latest build on a MacBookPro 233 w/OS X 10.4.9


1. I couldn't sign on with Safari, I had to use Firefox. Is there a Safari problem?

2. With the old build, and the new (I just upgraded 10 minutes ago), today's Cubs-Cardinals game doesn't show up at all as an option. All the other games are listed. I was able to sign in by clicking the video link on the MLB.com scoreboard page. That takes me into the regular video feed, not mosaic. Is there any reason why the game won't show up on Mosaic?

Yea the Mac version isn't showing the Cubs game at all. We are aware of this and working on it now.

The web streams are your best bet for this game.

I've been using the highest quality with the old version. Forme, the rebuffering has not been as bad as you have it. It rebuffers once in a while, no set pattern. Sometimes it goes for a long time without rebuffering at all. There have been only a few annoying outages. I do have 2 gigs of memory to your 512 MB. That might have an effect. The techs here will know better.


BTW, I don't think that Flip4Mac has any bearing on Mosaic.

They say Flip4Mac is a requirement for Mosaic.

Click on the Apple icon, Select "About this Mac"
For video card information Select "more info" then select "Graphics / Display"

Yes, flip4mac is required for the Mosaic, and a BIG yes to 2GB vs 512MB affecting performance. 512MB is the least amount of memory you can have to have the mosaic function. To have it function well, you will want more in every category.


Recommended System would be

2GHz Processor

1GB Memory

128MB video memory

I have no idea about your Mac. I can tell you that when I was using my old G4 667 PowerBook during spring training, the picture quality was inferior to my new machine, and did have to rebuffer more often (using the regulsr mlb.tv link). I have no frame of reference for Mosaic because it wouldn't work on that system.

Ok, but the problem that I have is that when I read the requirements before I signed up for Mosaic is that the Processor, the Memory, and Video Memory wasn't mentioned as a requirement. If it was then I overlooked it. All I saw was, that this year it's MAC compatible, you need, a certain bandwith, you need Safari or Firefox, you need Windows Media Player or Flash Player. Now after I sign up for it, there seems to be more requirements.

I mean, thousands of people were having problems with Mosaic at the beginning, and I bet that they didn't know anything about video card and memory and all that stuff.

How come I can't view games in single-game mode today? I double-click on the Cubs-Cards game and Mosaic doesn't respond.


I can see it in 4/6 mode but Mosaic won't respond to my attempts to go to single-game mode.

New build and even more problems than before. A 2" screen that cant be resized or maximized. Live games not showing up. This is just getting ridiculous; and I bet MLB isn't even considering any kind of compensation for their paying customers.

I have spent hours speaking with the help desk with no result. My Mosaic worked fine untill yesterday, now I receive an error message that states the following:Couldn't read TVScript Application from C:/ProgramData/MLB TV Mosaic/ TVScriptApp/mlb_broadband_ondemand_2007.qcb:
Error HRESULT E_FAIL has been returned from call to COM component.

Any suggestions?

where's the help? gone home for the day? answer all posts til 3 then nothing. the cubs game is in the ninth now. i think mlb should seriously consider giving all of us a discount for being the guinea pigs for this so called revolutionary technology. there is no way they should be charging what they are for what is basically a beta program. just my two cents.

My understanding is TRUE full screen will not return until we have the feature to turn it on or off.

The small screen problem persists. When I maximize, I get nothing. When I click on a screen while in small screen mode, I get mlb.com.


Two days of this nonsense.

My teenage son has it exactly right: why would mlb or anybody charge so much for a work-in-progress? All of these issues should have been worked out from Opening Day or the service should be free for a month while they get the bugs worked out.

When I first turn on the mosaic everything is working fine. I can switch back and forth from x6 to x4 to x1.I can select the games I want by doing the dragging bit, with no problems at all. At this point I can rival the quality of the person who put the pictures in their comment. My problems start to happen when I start double clicking on the small screens going across the top of the page to select a game to watch on X1. Right now all but one screen is blue. Clicking on these screens right now, you get the message that the game you have selected is currently not live etc,etc,etc. I have been experimenting by clicking on these screens for the past hour or so. These things work erratically. Sometimes, they will work and you get the message. If you double click on these things long enough switching from game to game, all the controlls on the front panel will lock up. Sometimes it takes 3 or 4 double clicks other times it may take 8 or 10 double clicks. But it will eventually lock up the controlls. When I say lock up the controls I mean x1,x4,x6.Teams,Preferences and the little screens them selves etc. When this happens you have to close mosaic and reload it from the desktop icon. You don't have to uninstall/reinstall.Sometimes you get error messages and sometimes you don't.


The STL/CUBS game just finished. Their was a brief time between when the game finished and when I was able to get the message that said the game selected is not currently live etc,etc. During this brief time I was getting the buffering error, retrying message when double clicking on the little screen

This brings us to the Boss buttton,why ever the **** that's on their for. When you click this button,a web page comes up, but you also close down the Mosaic.

There is a bug in the Cardinals/Cubs archive. Not sure if it is in other archives or not. The game is listed as 2:37:44 long. I wanted to watch the last half inning. So I drag the slider at the bottom to the very end. At 2:37:44 (supposedly the very end) it is the top of the ninth. There is no way that I can see to pull the tab any further. So now I have to wait until the top of the ninth finishes. The clock is already 3 minutes past the supposedly length of the game (2:40:05/2:37:44).

Nothing on the mosaic requires a double click. You click once to select and again to enter. If your machine is on the low end it may be responding slowly to your clicks and "lagging" behind. I will try to reproduce the issue you are seeing, but so far it has not been a problem. When a game is over there is a time when it's state is over, (no new users can click into the game) but you can still be in single game watching the game. That is just how it works for now.

after a great day yesterday, Mosaic is totally screwed up today. I have the big MLBTV logo backdropped behing the 6 screen in low resolution and can't get the udpater to work. Sheesh !!!

I also get no games even in low res. None.

When will that feature be applied. Sooner then later I hope.

Also, the timing of the player alerts has been off the last week. Saying a player is on deck long after they had their at bat.

Ok, now I see there was another build and I downloaded mosaic again and its working again. I didn't realize there was another update. I hope this fixes it for a while.

I too have to minimize Mosaic to be able to see any other windows or even my tool bar. I really hate that so as soon as you guys can fix that the better.

how do i download it again, i deleted it, and now i need to re-install, can someone help me out, when i go to MLB premium, its askin gme to buy it again (yeah Right). Someone help me out please!!

As for buying premium again, MLB had a problem where autorenewal accounts are being turned off by accident. Happened to me and I called customer service they said my account was closed, and creditcard refunded. I had to re-buy the thing.

You will be able to tell if your account closed if the webplayer asks you to buy premium and if you get directed to MLB.com purchase page when you try to access single games in mosaic.

Since I am basically illiterate when discussing drivers etc. I have just let things hopefully work out but am still having buffering and stream errors. Afraid machine is not compatible.

ok hogan thanks, I do not think they killed my subscription because i still can see all 6 games and hear them, and when i click on a game it tales me to the MLB.com Homepage, but not to the purchase screen. also i noticed when i use the arrow keys i can bounce around the mosaic but when i hit enter, i get a small screen inside a larger big screen. This thing is driving me crazy. last question how do i un-install what i have now so i can re-install the new one thanks again

For mac users that only want to watch single games and are unhappy with Mosaic, I would recommend not using it. Instead use Quicktime Player. This works much better for me. It allows me to watch games in Full Screen and I can eleminate the 4-sided border on 16:9 games so they fit exactly on my 16:9 tv. And also timeshift.

Here is what I do:

-Open Flip4Mac control panel in System prefs.

-Click Launch Quicktime player under the plug-in tab

-Click on the stream you want here: http://mlb.mlb.com/mediacenter/index.jsp

-The stream will open in Quicktime

-Present movie in Fullscreen

You can also timeshift this way. Pause/REW/FF etc.

I normally wait 20mins or so and then skip commercial breaks. Aren't you guys sick of PacMan?

Here is an AppleScript I wrote to automatically skip ahead 1min 45sec:

tell application "QuickTime Player"

set SkipAheadMins to 1.75

set OldTime to the current time of movie 1

set the current time of movie 1 to (OldTime + (SkipAheadMins * 60 * the (time scale of movie 1)))

end tell

Paste that into an AppleScript file and save as app. put it in dock, use for every commercial break. You can change the 1.75 in the script if you want to change the skip interval.

To Zoom in on 16:9 content to "remove" letter box Zoom in with your mighty mouse or open the Univeral Access Control Panel in Sys prefs and turn on Zoom under the seeing tab.

For those that want to stretch 4:3 content to fill your screen you can probably do that using the Quicktime Player as well. I have not tried this becuase i think it looks TERRIBLE! :)

Guys, thanks for all your work. I know you're receiving heaps of contempt, but tonight Mosaic looks as good as it ever has. Not one odd frame, no audio sync woes, commercial timed properly.

Another fullscreen-related issue. If I start Mosaic, load up a game, go to fullscreen, then back to windowed, the window is now always on top of all other windows.


I don't recall this happening before, and I would have done the same thing before.

I must have a different Mosaic then. I'm in X6 mode and I'm talking about the 16 icons that go across the top of the screen,Baseball Channel TV being the last one. When you click on these once, you get a second little icon that you can drag down to one of the 6 viewing screens. You can select any six games and put them on any one of the six screens. If there is a game already on one of the screens ,you can change the game by dragging the little icon over it. This part I never had any problems with.
However, when you double click on these little icon's, it takes the game you clicked on into X1 mode.

If you keep changing the game by double clicking on the little icons,sooner or later all the controls on the front panel will lock up.The audio/video remains ok. You can't change anything any more It's irratic as to how many times you have to change the games. I just reinstalled Mosaic and I just duplicated the problem several times.

so i ran into a confusing problem. i left my internet explorer in offline mode when i started up mosaic. i couldn't figure out why none of the streams were working.. well, it was because of the offline mode. when i tried to hit a web page in IE, it asked if you want to connect, connected, and mosaic started to work again.

My problems are completely fixed!! The problem was that my laptop's power management program was not giving 100% to my CPU. Anyone with a laptop or a computer with power management software that is experiencing problems should check this!!!!

One thing I've noticed, mosaic on both high and medium is working almost perfectly with the new build, I'm very pleased with that. HOWEVER THE SINGLE GAME STREAMS NEED TO BE FIXED! IT IS VERY FRUSTRATING TO HAVE FREEZING EVERY COUPLE MINUTES! Please work on this.

When trying to go from full screen back to a smaller window, I'm getting a browser that's about four inches by three inches. When I click on the 'expand button, the browser fills the screen, but the video window stays the same size.

Balitimore. It's working for me but I also am getting the freezing in single games every other pitch. Yesterday was the best Mosaic worked for me until the new build. Very little if any freezing.

Today I uninstalled Mosaic and reinstalled it.


It still says "loading" after I double-click and won't do anything else. I sent the diagnostic information as requested a couple of weeks ago and never heard anything back.

Help.

I have the same problem as davsalza@aol.com. Then I uninstall and reinstall the program. It works fine then until I exit out of it. Then the next time I try to log into it it tells me it is unable to read tvscrip application.


I fixed my own problem. I run mosaic as an administrator and it lets me log right in. I would like to have true full screen though.

Once again I can not get Mosaic to open. I receive the same error message as I reported yesterday. I also tried the link mosaic provided which launched and opened. However, once I exit I can not reopen unless I reinstall. I did not sign up for this product to install and reinstall every time I want to watch some games.

its early morning, i uninstalled and reinstalled and things look good, lets see what happens when the games start and i start bouncing around from game to game to follw my team.

Watching the Mets, single game. I clicked on the higher bar for video quality but the game kept freezing. OK in lower quality mode.

davsalza@aol.com I was having the same problem as you. if you right click on the mosaic icon and then choose "run as administrator" it should work. It worked for me

Okay, so I was doing fine with this until the latest update, when I got the same issue many have mentioned here, namely the minimized screen that when you enlarge just goes to a black screen. Useless. So I followed the advice and reinstalled, and now when I try to load it just gives me a series of "Unhandled exceptions" that result in nothing other than a dark screen again. Please fix this. These updates seem to cause more problems than they fix, at least for me.

Please:
1. Get rid of the pop up saying there has been no activity. It's unnecessary and annoying.

2. Bring back true full screen. Or at least give us an option.

3. Continue improving the image quality, especially in multi-game view.

4. Continue to work on audio/video sync problems.

5. Sync the game feed with the "Game Status" tab's balls/strikes/outs.

6. Get rid of the pop up saying there has been no activity. It's unnecessary and annoying.

I have to agree with this one - I can't watch a game in the background without me clicking on the window once and a while. And why should it have to reconnect? I missed A-Rod's second home run last night.

Other than that - I love it. I am a Sox fan in London, and this is the only way I can see any games. Will national blackouts affect those in other countries? I hope not!

Well, I'm happy to say that things have been working quite well for me for quite a few days.
Been watching complete games with little to no rebuffering. The main problem I am having with Mosaic is the Audio sync - got fed up today during the Mets game and switched to watching via the website.

Also, is there any chance that the broadcast could be extended to include Pre and Post game shows?

04/21/07 For starters I understand this program is new, and I do enjoy watching the games, but I'll report anything that needs improvement. Is the Cubs / Cards game still on Preview status for anyone else? The game can only be watched on the smaller screens.

Someone please explain to me how a national blackout is applied to a regional brodacast. Thanks to the "wisdom" of MLB and FOX I am precluded from watching the Red Sox-Yankees today. But, oooh, lucky me, because I live in Colorado, I can watch the Cubs and Cardinals. Are you freakin' kidding me? What a Joke!!!! It seems to me that while MLB has licensed their product to FOX, MLB has the obligation to either assure Fox broadcasts those blacked out games nationally or lift the restriction. Make no mistake, this isn't about one game on one day. This is about me, a paying subscriber, being disserviced for an entire season of Saturdays. Further and without exception, Fox baseball broadcasts are about as exciting as watching Congress on C-Span. Most disturbing of all is that this Saturday policy was never mentioned to subscribers prior to the season. I paid for ALL "out of market" games (as advertised) which this clearly is. Out of market means not in the local area or region where coverage is generally available for a specific team. The way this was marketed is tantamount to FRAUD!!!!!!. FOX, Dish network; Maybe it's time for for Senator Kerry and the rest of Congress to look into MLB' anti-trust exemption!

What’s most frustrating to me about the inconsistency policy regarding the Saturday blackouts. The first week all games before 7pm were blacked out. Last week the only game blacked out was the one Fox game available in my local market (my out-of market Fox games were not blacked out and available). This week all 4pm Fox games are blacked out. The policy states all nationally televised games will be blacked out. The regional games on Fox are not nationally televised so why are they blacked out. Someone needs to explain the policy to us. Do not just post a link with the policy, please explain why each week different games are blacked out and why is there an inconsistency.
